Please take the time to read our terms and conditions to ensure you understand exactly how we operate. Make sure you are happy with and accept our terms and conditions before submitting your ad, making an enquiry or browsing our website.

Costs

Private Sellers: Plane Sales charges a once only fee to list an aircraft for sale. The cost for private sellers is $75.00 per aircraft listing.

Commercial sellers: We have a discounted rate of $55.00 per aircraft for individual listings.

What We Are Paid For

We are not aircraft commercial sellers or agents. We receive no commission if an aircraft is sold. Our income is derived through the private individuals and commercial sellers who pay a fee to list an aircraft on the site. We will not and do not have anything to do with the financial transactions involving an aircraft sale or purchase.

Late Payments

Adverts that are not paid for within 7 days will be removed from the site at the site administrator's discretion.

Refunds: We do not give refunds if you fail to sell your aircraft or change your mind about selling your aircraft.

Management of listings: Once a listing has been created and published it is your responsibility to keep it updated. We have been receiving a lot of requests from people to update their ads. This increases our workload (and costs), so accordingly, from 10 Dec 2023 any listing update requests will now incur a $25.00 fee. This will be at the discretion of site admins. (Of course you're welcome to edit your own listings at no cost)

The material on Plane Sales provides general information only. It is not intended as advice and must not be relied upon as such. You should make your own inquiries and take independent advice specific to your circumstances prior to making any decisions, including that regarding the purchase or sale of an aircraft and or spare part.

Due Diligence

Plane Sales makes no representation about the items presented for sale. It is up to you, the potential purchaser, to conduct checks to ensure the product meets your expectations. Plane Sales offers no warranty for goods purchased through this site. We do not accept any responsibility for the accuracy of the description of aircraft listed on the site. It is the purchaser's responsibility to investigate and confirm the exact aircraft and quality of aircraft they may purchase and to reach an agreed purchase price with the seller.

Pricing in foreign currency's and GST

Depending on the tax status of the seller and the method of sale, the price advertised may or may not include various State and Federal charges. These could include Stamp Duty, Fees, Levies, Registrations and GST. Please confirm the total price and any additional charges that you may incur with the seller of the Aircraft and or your Accountant.

Private Sellers, Aircraft Dealers and Agents may advertise aircraft and goods with or without GST. This is at their discretion. Pricing is set by the aircraft sellers, not Plane Sales Australia. As a buyer or seller you must seek clarification from your Accountant or the Australian Tax Office (ATO) as to the GST status of your sale or purchase.

There may also be instances where a seller advertises an aircraft or part in a currency other than Australian Dollars. This is at their discretion as they are the seller. As a potential buyer you must factor in currency conversions as they relate to the sale price.

Plane Sales Australia are not liable for any loss incurred by either a seller or buyer due to their lack of due diligence.

Licensing

Plane Sales has no responsibility for ensuring you are appropriately licensed to fly the aircraft you're purchasing. It is up to the purchaser and or their agent to ensure they hold the appropriate ratings and type certification to fly the aircraft they're purchasing.

Use of Information

Except for the material held in your computers cache or a single permanent copy of the material for your personal use, as part of your responsibilities as a Plane Sales website user, you are prohibited from:

• Modify, copy, distribute, transmit, display, perform, reproduce, publish or license any material.
• Using any data mining bots or similar data or image gathering software and extraction methods in connection with the Plane Sales website or its content.
• Use or attempt to use any material published on the Plane Sales site to create any web site or publication.
• Mirror or frame any web site or page within the Plane Sales website.
• Reverse engineering the website or any of the Plane Sales content
• Use any automated process of any sort to query, access or copy any material on Plane Sales or generate or compile any document or database based on the material published on Plane Sales
• Transfer or sell any information, functionality or products or services offered on the Plane Sales website.

Termination of Your Ad

Plane Sales may, on notice to you, and at its discretion, terminate your access to all or part of the site without the need to provide reasons. We may also terminate any advertisement that we deem to be offensive, defamatory or not within the bounds of normal public decency.

State and Federal Taxes - GST

Plane Sales Australia our Dealers and private sellers are not tax advisers and are not able to advise you as to the GST status of any aircraft or part for sale. It is at your discretion and you are strongly advised to seek independent taxation advice from your Accountant in this respect.

Copyright

The material provided on Plane Sales is copyright protected. You may use this material for your own personal reference only. Except for the temporary copy held in the computers cache and a single permanent copy for your personal reference, the material may not otherwise be used, copied, reproduced, published, stored in a retrieval system, altered or transmitted in any form or by any means in whole or part without the prior written approval of Plane Sales.

Images

It is not the job of Plane Sales to edit or modify images that are obviously the intellectual property of a third party.
PLEASE DO NOT USE IMAGES THAT YOU DO NOT HAVE PERMISSION TO USE.
You, as the private seller or appointed agent of the aircraft, are responsible for ensuring you have legal right to use any images you upload in presenting the aircraft for sale. All listings on Plane Sales are scrutinized by our site admins. Any image that appears to be copied from another website or image gallery may result in the seller being contacted and asked to provide proof of ownership of said image. Images used in the aircraft listing and spare parts section of the site are the property of the seller or listing creator, not Plane Sales Australia. By uploading these images you are declaring you have the legal right to use these images for your listing. If Plane Sales are contacted by an individual or company who claim image ownership, we will hand over your contact details and you may be subject to legal action for breach of copyright.

Any image uploaded to the Plane Sales website may be used at any time on social media or in our newsletter.

The use of AI images and content

Both buyers and sellers need to be aware of the increased use of AI images and content. Please ensure you do your due diligence as images and content may not be a true reflection of the part or aircraft for sale.

Social Media

Plane Sales are active users of Social Media as it forms a large part of how we promote you and your listing and or business. We may put information such as your contact details, images and comments on our Social Media pages, including but not limited to Facebook, Twitter, Google +, LinkedIn and Instagram. Please contact our site admins if you do not wish this to occur.

Newsletter

As part of being a Plane Sales user you will automatically be signed up to our weekly newsletter. Please unsubscribe from this if you don't wish to receive it.

Trademarks

The trademarks, service marks, designs, and logos (collectively, the "Trademarks") displayed on this site are the registered and unregistered Trademarks of Plane Sales. Use of the Trademarks displayed on this site, except as provided in these terms, is strictly prohibited

Third Party Links

Hyperlinks and pointers to websites operated by third parties will appear on Plane Sales from time to time. These websites do not form part of Plane Sales and are not under the control of Plane Sales. We do not take any responsibility for the contents of any such hyperlink or linked website. The views and opinions offered on these sites are those of the site owners and do not represent those of Plane Sales. If you follow a link to any such websites, you leave Plane Sales and do so entirely at your own risk and choice.

Advertisers

Plane Sales offer no warranty or recommendation for any businesses who advertise on our websites or social media platforms. These businesses are paying advertisers and are not associated with Plane Sales. Please do your due diligence when dealing with third parties.

Monthly Newsletter

Plane Sales may send out a monthly electronic newsletter. By agreeing to these terms and conditions you are giving Plane Sales permission to send you this newsletter. If you do not wish to receive further newsletters, simply click the unsubscribe button at the bottom of the page when you receive your first edition.

How are we Paid

Plane Sales offer paid online listing services only. We are not buyer's agents or aircraft dealers. We do not take part in any buy/sell transactions. Our income is derived from the payments that sellers make to list their aircraft on our site.

Warranty/Guarantee

As we are an online listing service, we offer no warranty or guarantee for the products listed for sale through our site. It is up to you, the buyer, to ensure that any offered warranty or guarantee is applicable to what you are purchasing. Persons or business purchasing items listed on Plane Sales are advised to do their due diligence with regard to the goods or services.

We reserve the right to alter these term and conditions

Plane Sales Australia may at any time and, in its absolute discretion, modify or amend the terms and conditions upon which goods or services are supplied by you. We will always publish our Terms and conditions on the Plane Sales Australia website. Such modifications will be binding on you once displayed on this web site. You should regularly check the terms and conditions displayed on this web site.
